Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Holler Management (“Holler,” “we,” “us,” or “our”) application portal at apply.hollermgmt.com and any related management services. By accessing or using our portal, you agree to be bound by these Terms. If you do not agree, do not use the portal.

Eligibility and Invite-Only Access

Access to the Holler application portal is by invitation only. You must possess a valid invite code issued by Holler Management or an authorized referral partner to submit an application. Invite codes are single-use, non-transferable, and may expire. Sharing, selling, or misusing invite codes is prohibited and may result in revocation of access. We reserve the right to reject any application or revoke any invite code at our sole discretion.

Artist Representations and Warranties

By submitting an application and entering into a management relationship, you represent and warrant that:

  • All information provided in your application is accurate, current, and complete.
  • You are the rightful owner or authorized representative of the artist or act you are submitting for management.
  • You have the legal authority to enter into management agreements and booking contracts on behalf of the artist or act.
  • Your music, promotional materials, and uploaded content do not infringe on any third-party intellectual property rights.
  • You are at least 18 years of age, or have the consent of a parent or legal guardian.
  • You are not currently under an exclusive management agreement with another party that would conflict with Holler’s services.

Commission Structure

Holler Management operates on a 10% commission model. We earn 10% of all gross income generated through gigs and engagements booked or facilitated by Holler on your behalf. This includes live performances, event appearances, and any other paid engagements arranged through our services. Commission is due upon receipt of payment from the venue or event organizer. No commission is charged on income from gigs or engagements you secure independently without Holler’s involvement.

AI-Assisted Services

Holler Management is an AI-native company. Our management services are delivered with the assistance of artificial intelligence, including but not limited to: venue pitching, email communication with bookers, booking inquiry qualification, calendar management, and negotiation support. Human team members oversee AI operations, review edge cases, and manage high-stakes decisions. By engaging our services, you acknowledge and consent to the use of AI in performing management tasks on your behalf. While we strive for accuracy and professionalism in all AI-assisted communications, you understand that AI systems may occasionally produce errors.

Intellectual Property

You retain all ownership rights to your music, recordings, compositions, trademarks, brand assets, and other intellectual property. By engaging Holler’s services, you grant us a limited, non-exclusive license to use your:

  • Artist name, likeness, and biographical information for promotional and booking purposes.
  • Press photos, EPKs, and promotional materials to pitch venues and secure bookings.
  • Music samples or streaming links to share with venue bookers as part of the booking process.

This license is limited to the scope of management services and terminates upon the end of the management relationship. Holler does not claim ownership of any artist content.

Use of the Portal

When using the Holler application portal, you agree not to:

  • Provide false or misleading information in your application.
  • Attempt to gain unauthorized access to the portal or its underlying systems.
  • Use the portal for any unlawful purpose or in violation of any applicable laws.
  • Interfere with or disrupt the operation of the portal.
  • Reverse engineer, decompile, or attempt to extract the source code of the portal.

Termination

Either party may terminate the management relationship at any time with 30 days’ written notice. Upon termination, commission remains due on any gigs booked during the management period, even if the performance occurs after termination. Holler reserves the right to immediately terminate access to the portal and management services if you breach these Terms or engage in conduct that is harmful to Holler’s reputation or operations.

Limitation of Liability

To the maximum extent permitted by law, Holler Management shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of bookings, or loss of data, arising from your use of the portal or management services. Our total liability for any claim arising from these Terms or our services shall not exceed the total commission paid by you to Holler in the 12 months preceding the claim. We do not guarantee any specific number of bookings, income level, or career outcomes.

Disclaimer of Warranties

The portal and management services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the portal will be uninterrupted, error-free, or free of harmful components.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising from these Terms or the management relationship shall be resolved in the state or federal courts located in Boulder County, Colorado.

Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page with a revised “Last updated” date. Your continued use of our portal and services after any changes constitutes acceptance of the updated Terms.
